1. GENERAL INFORMATION & ACCEPTANCE OF TERMS
The website Fashion-Brands.store (the “Site”) and all related services are provided by Fashion Brands, the trading name of Moby-SIM d.o.o., a company registered in Bosnia and Herzegovina (Poslovni centar 96, Via Mall bb, 72250 Vitez, Commercial Court number: 051-0-Reg-24-000637, Company tax code: 236815010009, Company ID number: 4236815010009).
Moby-SIM d.o.o. operates as a certified authorised reseller in partnership with official suppliers and authorised distribution centres in the European Union and the United States.
By accessing or using our Site, including placing an order, you agree to be bound by these Terms of Service (“Terms”) and any additional policies published on the Site (Shipping Policy, Returns & Refund Policy, and Privacy Policy). We recommend that you save or print a copy for your records.
Fashion-Brands.store offers both new luxury fashion products sourced from official channels and authenticated preloved luxury fashion products. Certain provisions of these Terms apply specifically to Preloved Products and should be reviewed carefully before purchase.
You must be at least 18 years old and legally competent to enter into a binding contract to place an order. We reserve the right to refuse service to anyone who does not meet these criteria.

We may update these Terms periodically. Continued use of the Site after changes constitutes your acceptance of the revised Terms. Changes made after an order has been placed will not affect that order unless required by law.
2. CHANGES TO THESE TERMS
We reserve the right to update or modify these Terms at any time. Changes will take effect upon publication on the Site.
3. ELIGIBILITY
To place an order on Fashion-Brands.store, you must be at least 18 years old and legally competent to enter into a binding contract. We reserve the right to refuse or cancel any order from individuals who do not meet these requirements.
4. ACCOUNT REGISTRATION
Certain features require account registration. You agree to provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Please notify us immediately of any unauthorised access.
We may suspend or terminate accounts involved in fraud, abuse, or breach of these Terms.
5. PURCHASE CONDITIONS
By placing an order, you confirm that all provided information is accurate and that you are authorised to use the selected payment method.
Fashion-Brands.store primarily offers new luxury fashion products sourced directly from official distribution channels and authorised wholesalers in the European Union and the United States. We also offer a carefully selected range of authenticated preloved luxury items.
When purchasing a Preloved Product, you acknowledge that the item has been previously owned and may show signs of wear, aging, storage, handling, or use consistent with its age and condition. Product descriptions, photographs, condition notes, and grading information form an integral part of the item’s specification and must be reviewed carefully before purchase.
All products (new and preloved) are sold for personal or gift use only. Commercial resale is strictly prohibited unless you are an authorised reseller or business partner.
We reserve the right to limit quantities per customer, household, or address and to conduct fraud prevention, credit, or identity checks where necessary.
6. ORDERS & CONTRACT FORMATION
All orders are subject to availability and acceptance. A binding contract is formed only when we send you a confirmation that the goods have been dispatched. The contract is concluded in Vitez, Bosnia and Herzegovina.
You will receive an acknowledgment email upon order placement. A second confirmation email with dispatch and tracking details (where available) will follow.
Fashion-Brands.store reserves the right to refuse or cancel orders in cases such as payment failure, suspected fraud, pricing errors, stock unavailability, shipping restrictions, or breach of these Terms. In such cases, a full refund will be issued if payment has already been made.
We reserve the right to restrict new orders if there are outstanding unpaid charges (e.g. customs duties, return shipping fees, or other order-related costs).
7. PRICING & TAXES
Prices displayed on the Site are for informational purposes. At checkout, all prices are in Convertible Marks (KM) and include applicable VAT.
For DDP (Delivered Duty Paid) destinations, import duties and taxes are included where possible. For DDU (Delivered Duty Unpaid) destinations, you are responsible for customs duties, taxes, and clearance fees.
We reserve the right to correct obvious pricing or typographical errors and cancel the order with a full refund.
8. PAYMENT
We accept payments via Mastercard, Maestro, Visa, Google Pay, and Apple Pay through our secure payment provider Monri WebPay (PCI DSS Level 1 certified).
All transactions are processed securely using the latest TLS encryption and SSL protocol with 128-bit encryption. We do not store sensitive card data (full card numbers, CVV/CVC, or PINs). We implement multiple fraud prevention measures, including 3D Secure authentication.
We also accept payments via PayPal, which provides a secure and convenient payment option for our customers.
We reserve the right to cancel orders if payment authorisation fails or if fraud is suspected.
9. DELIVERY
Delivery terms are detailed in our Shipping Policy, which forms an integral part of these Terms. Products may be shipped from distribution centres in the European Union or the United States.
We aim to dispatch orders within 1-14 business days of acceptance (subject to payment verification and stock availability). Average delivery times vary by destination.
Risk and ownership pass to you upon delivery. We are not responsible for delays caused by customs authorities, force majeure events, or circumstances beyond our reasonable control.
You are responsible for ensuring that the products can be legally imported into your country. For unclaimed, refused, or returned packages due to incorrect address or failure to collect, you will be responsible for return shipping costs, customs charges, and a fixed handling fee (minimum €45 or equivalent in KM). Additional costs may be invoiced.
All packages are insured against loss only (subject to carrier approval). In case of confirmed loss, we will reship or refund after claim processing.
10. RIGHT OF WITHDRAWAL & RETURNS (EU CONSUMERS)
If you are an EU consumer, you have the right to withdraw from your purchase of new products within 30 days of receiving the goods without giving any reason. Refunds will be processed in accordance with our Returns & Refund Policy.
This right does not apply to:
- Personalized goods
- Sealed goods not suitable for return for hygiene reasons (if unsealed)
- Items returned in non-resalable condition
- Preloved / Pre-owned items (except in cases of proven non-conformity or defect not disclosed in the description)
All returns are subject to quality inspection. Returns must be in perfect original condition with all tags, boxes, dustbags, and packaging. Return shipping costs are borne by the customer unless the item is defective. We reserve the right to refuse returns if items show signs of wear, washing, or use.
Refunds (where approved) will be processed via the original payment method within 5 business days of approval.
11. LEGAL CONFORMITY GUARANTEE
Consumers in the EU are entitled to a 24-month legal conformity guarantee under applicable consumer protection laws.
For new products, statutory consumer rights apply in accordance with applicable law.
For Preloved Products, conformity shall be assessed taking into account the nature of pre-owned goods, their age, condition, expected wear, and any imperfections, repairs, alterations, or signs of use disclosed in the product description or visible in product photographs.
Minor signs of wear, material aging, patina, surface marks, scratches, discoloration, creasing, corner wear, hardware wear, interior wear, or similar characteristics consistent with the age and condition of a Preloved Product shall not constitute defects or lack of conformity.
Product condition descriptions, grading assessments, photographs, measurements, and item specifications form an essential part of the contract and shall be considered when determining conformity.
Due to the unique nature of Preloved Products, minor differences between product photographs and the actual item, including signs of age, wear, patina, discoloration, material softening, scent associated with storage, or other characteristics consistent with the disclosed condition, shall not constitute a lack of conformity or grounds for a claim that the item was not as described.
Unless expressly stated otherwise in the product description, Preloved Products are sold without any manufacturer's warranty. Any remaining manufacturer's warranty, if applicable, shall transfer only to the extent permitted by the manufacturer and applicable law.
Nothing in this section limits mandatory consumer rights that cannot be excluded under applicable law.
If goods are defective or not as described, you may request repair, replacement, price reduction, or refund as provided by law.
12. AUTHENTICITY OF PRELOVED PRODUCTS
All Preloved Products offered on Fashion-Brands.store are represented as authentic. They are sourced through trusted suppliers and reputable channels.
Each preloved item undergoes authentication prior to being offered for sale. Product condition descriptions and grading (where provided) represent our assessment at the time of listing and serve as a guide only.
All measurements are approximate, and minor variations in appearance, colour or details due to photography, lighting or the pre-owned nature of the item may occur and do not constitute a defect.
13. INTELLECTUAL PROPERTY
All content on the Site is protected by intellectual property laws. You are granted a limited, non-exclusive, revocable license for personal, non-commercial use only. All trademarks and brand names remain the property of their respective owners.
14. USER CONDUCT & LIABILITY LIMITATION
You agree not to use the Site for unlawful purposes, interfere with its security, upload malicious content, or engage in fraud.
To the maximum extent permitted by law, our liability is limited to the value of the purchased goods for direct losses caused by our breach. We are not liable for indirect, consequential, or punitive damages, including loss of profits or data.
To the maximum extent permitted by law, Fashion-Brands.store shall not be liable for claims arising from normal wear, aging, patina, or characteristics consistent with authentic pre-owned luxury goods.
Nothing in these Terms excludes liability for death, personal injury caused by negligence, fraud, or any liability that cannot be excluded by law.
15. INDEMNIFICATION
You agree to indemnify and hold harmless Moby-SIM d.o.o. from claims arising from your misuse of the Site or breach of these Terms.
16. FORCE MAJEURE
We are not liable for failure or delay in performance caused by events beyond our reasonable control, including natural disasters, strikes, war, pandemics, or governmental actions.
17. GOVERNING LAW & JURISDICTION
These Terms are governed by the laws of Bosnia and Herzegovina. Disputes shall be subject to the jurisdiction of the competent courts in Bosnia and Herzegovina. EU consumers retain their rights under mandatory consumer protection laws of their country of residence.
18. PRIVACY & DATA PROTECTION
We process personal data in accordance with applicable laws, including the General Data Protection Regulation (GDPR) where relevant. Please review our Privacy Policy for full details.
