1. GENERAL INFORMATION & ACCEPTANCE OF TERMS

The website www.fashion-brands.store (the “Site”) and all related services are provided by FASHION-BRANDS.STORE (“FASHION-BRANDS.STORE”, “we”, “us”) subject to these Terms of Use & Service (“Terms”) and any additional policies published on the Site. By accessing or using our Site, including placing an order, you agree to be bound by these Terms. We recommend saving or printing a copy for your records.

Fashion-Brands.store offers both new luxury fashion products and authenticated pre-owned luxury fashion products ("Preloved Products"). Certain provisions of these Terms apply specifically to Preloved Products and should be reviewed carefully before placing an order.

FASHION-BRANDS.STORE is the trading name of Moby-SIM d.o.o., registered in Bosnia and Herzegovina, Poslovni centar 96, Via Mall bb, 72250 Vitez, Commercial court number: 051-0-Reg-24-000637, Company tax code: 236815010009, Company ID number: 4236815010009

Moby-SIM d.o.o. operates in accordance with an authorization certificate issued by its partner company / official supplier.

According to the certificate, all authorized distributors of the brands listed at https://fashion-brands.store/pages/brands permit Moby-SIM d.o.o. to act as an official partner and authorize the company to purchase luxury fashion items from the partner company / official supplier for the purpose of resale to end customers in the ordinary course of business.

The certificate further confirms that all luxury fashion products sold by Moby-SIM d.o.o. are 100% authentic and sourced through authorized distributors, official suppliers, trusted luxury fashion networks, and other reputable supply channels.

We specifically encourage you to review our purchasing terms and Privacy Policy. If you are under the age of 16, you must inform your parent or legal guardian about our Privacy Policy before registering or using our services. We reserve the right to accept orders only from individuals aged 18 or older.

We may update these Terms periodically. Continued use of the Site constitutes acceptance of any revisions. Changes made after an order has been placed will not affect that order unless legally required.

3. ELIGIBILITY

By placing an order, you confirm that all information provided is accurate and that you are authorized to use the selected payment method.

By purchasing a Preloved Product, you acknowledge that the item has been previously owned and may show signs of wear, storage, handling, aging, or use consistent with its condition and age. Product descriptions, photographs, condition notes, and grading information form an integral part of the product specification and should be reviewed carefully before purchase.

Products are sold exclusively for personal or gift use. Commercial resale is prohibited.

We reserve the right to limit quantities per customer, household, or address.

We may conduct fraud prevention, credit checks, and identity verification through third parties where necessary.

6. ORDERS & CONTRACT FORMATION

All orders are subject to availability and acceptance.

Certain Preloved Products may be unique, one-of-a-kind items with limited availability. In the event of simultaneous purchases, inventory discrepancies, or supplier unavailability, Fashion-Brands.store reserves the right to cancel an order and issue a full refund.

Certain products may be offered simultaneously through multiple sales channels. While we make reasonable efforts to maintain accurate inventory levels, availability cannot be guaranteed until dispatch confirmation has been issued.

Placing an item in your cart does not reserve it.

After placing an order, you will receive an acknowledgment email confirming receipt. This does not constitute acceptance.

A binding contract is formed only when we send confirmation that the goods have been dispatched.

The contract is concluded in Vitez, Bosnia and Herzegovina.

We reserve the right to refuse or cancel orders in cases including but not limited to:

• Payment authorization failure
• Suspected fraud
• Pricing errors
• Stock unavailability
• Shipping restrictions
• Breach of these Terms

If payment has already been made for a canceled order, a full refund will be issued.

7. PRICING & TAXES

Prices are displayed in the currency of the visitor’s country and are for informational purposes only until checkout. At checkout, all prices are shown in Convertible Marks (KM), and all payments are processed in Convertible Marks (KM). VAT is included in all prices.

Prices of Preloved Products are determined individually based on brand, rarity, condition, age, market availability, and other relevant factors.

The applicable price is the one valid at the time of order confirmation.

In the event of an obvious pricing, description, technical specification, or typographical error, Fashion-Brands.store reserves the right to refuse, cancel, or amend an order and issue a full refund where applicable, provided that no binding contract has yet been formed in accordance with Section 6 of these Terms.

For DDP (Delivered Duty Paid) destinations, import duties and taxes are included.

For DDU (Delivered Duty Unpaid) destinations, customers are responsible for customs duties, taxes, and clearance fees.

International banking or currency conversion fees are the responsibility of the customer.

8. PAYMENT

Ordered products or services can be paid online using Mastercard, Maestro, Visa, Google Pay, or Apple Pay.

8.1. CREDIT CARD PURCHASE SECURITY STATEMENT

The confidentiality of your data is protected and ensured by using the latest version of TLS encryption. Online billing sites are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption is the process of encrypting data to prevent unauthorized access during its transmission.

This enables a secure data transfer and prevents unauthorized data access during communication between user and Monri WebPay Payment Gateway and vice versa.

Monri WebPay Payment Gateway and financial institutions exchange data by using their virtual private network (VPN) which is also protected from unauthorized access.

Monri Payments is PCI DSS Level 1 certified payment service provider regulated by Visa and Mastercard rules.

Credit card numbers are not stored by Merchant and are not available to unauthorized personnel.

8.2. PAYMENT SECURITY & CARDHOLDER DATA PROTECTION POLICY

At Fashion-Brands.store, we are fully committed to ensuring the highest standards of security when processing card payments and handling cardholder data. Our systems, processes, and partners are aligned with globally recognized security practices and industry standards.

Secure Payment Processing

All payment transactions are processed through certified and secure payment service providers that comply with the Payment Card Industry Data Security Standard (PCI DSS).

We use Monri WebPay Payment Gateway, a PCI DSS Level 1 certified payment service provider regulated by Visa and Mastercard rules.

We do not process or store sensitive cardholder data on our servers. All payment information is transmitted directly to the payment gateway using secure, encrypted channels.

Encryption & Data Protection

The confidentiality of your data is protected and ensured by using the latest version of TLS (Transport Layer Security) encryption.

Online payment pages are secured using the Secure Socket Layer (SSL) protocol with 128-bit data encryption. SSL encryption ensures that data is encrypted during transmission, preventing unauthorized access.

This enables secure data transfer and prevents unauthorized access during communication between the user and Monri WebPay Payment Gateway, and vice versa.

Additionally, Monri WebPay Payment Gateway and financial institutions exchange data through a secure Virtual Private Network (VPN), further protecting data from unauthorized access.

Cardholder Data Handling

We do not store:

• Full credit/debit card numbers
• CVV/CVC security codes
• PIN numbers

All card-related data is handled exclusively by our authorized payment providers in accordance with PCI DSS standards. Credit card numbers are not stored by the merchant and are not accessible to unauthorized personnel.

Fraud Prevention & Risk Monitoring

We implement multiple layers of fraud detection and prevention measures, including:

• Transaction monitoring systems
• Address Verification Systems (AVS), where applicable
• 3D Secure authentication (e.g., Verified by Visa, Mastercard SecureCode)
• Risk-based transaction analysis

We reserve the right to decline or cancel any transaction that appears suspicious or potentially fraudulent.

Third-Party Payment Providers

We partner only with a reputable and certified payment provider, Monri Payments.

The provider is responsible for securely processing and storing payment data.

Customer Responsibility

Customers are responsible for ensuring that:

Liability Disclaimer

While we implement the highest security standards, FASHION-BRANDS.STORE shall not be liable for unauthorized transactions unless such liability arises from proven negligence on our part.

9. DELIVERY

Delivery terms are detailed in our Shipping Policy, which forms an integral part of these Terms.

Risk transfers to you upon delivery to the address provided.

Ownership and title to the goods pass to the customer only upon full payment of the purchase price and delivery of the goods.

We aim to dispatch within 14-21 days of order acceptance unless otherwise stated.

We are not responsible for delays caused by customs authorities, force majeure events, or circumstances beyond our reasonable control.

Customers are responsible for ensuring that products ordered can be legally imported into the destination country. Fashion-Brands.store shall not be responsible for goods delayed, seized, returned, or destroyed by customs authorities due to local import restrictions.

10. RIGHT OF WITHDRAWAL (EU CONSUMERS)

If you are an EU consumer, you have the right to withdraw from your purchase within 14 days of receiving the goods without giving any reason.

Refunds will be processed in accordance with our Returns & Refund Policy.

This right does not apply to:

• Personalized goods
• Sealed goods not suitable for return for hygiene reasons if unsealed
• Items returned in non-resalable condition

Your statutory rights remain unaffected.

11. LEGAL CONFORMITY GUARANTEE

Consumers in the EU are entitled to a 24-month legal conformity guarantee under applicable consumer protection laws.

For new products, statutory consumer rights apply in accordance with applicable law.

For Preloved Products, conformity shall be assessed taking into account the nature of pre-owned goods, their age, condition, expected wear, and any imperfections, repairs, alterations, or signs of use disclosed in the product description or visible in product photographs.

Minor signs of wear, material aging, patina, surface marks, scratches, discoloration, creasing, corner wear, hardware wear, interior wear, or similar characteristics consistent with the age and condition of a Preloved Product shall not constitute defects or lack of conformity.

Product condition descriptions, grading assessments, photographs, measurements, and item specifications form an essential part of the contract and shall be considered when determining conformity.

Due to the unique nature of Preloved Products, minor differences between product photographs and the actual item, including signs of age, wear, patina, discoloration, material softening, scent associated with storage, or other characteristics consistent with the disclosed condition, shall not constitute a lack of conformity or grounds for a claim that the item was not as described.

Unless expressly stated otherwise in the product description, Preloved Products are sold without any manufacturer's warranty. Any remaining manufacturer's warranty, if applicable, shall transfer only to the extent permitted by the manufacturer and applicable law.

Nothing in this section limits mandatory consumer rights that cannot be excluded under applicable law.

If goods are defective or not as described, you may request repair, replacement, price reduction, or refund as provided by law.

12. INTELLECTUAL PROPERTY

All Site content, including text, graphics, images, trademarks, logos, software, and design elements, is protected by intellectual property laws.

You are granted a limited, non-exclusive, revocable license for personal, non-commercial use only.

Any reproduction, resale, modification, or commercial exploitation without prior written consent is strictly prohibited.

All trademarks, brand names, logos, product names, and other intellectual property displayed on the Site remain the property of their respective owners. 15. LIABILITY LIMITATION

To the maximum extent permitted by law:

We are liable only for foreseeable losses directly caused by our breach, up to 100% of the value of the purchased goods.

We are not liable for:

• Indirect or consequential damages
• Loss of profits
• Loss of business
• Data loss

Nothing excludes liability for:

• Death or personal injury caused by negligence
• Fraud or fraudulent misrepresentation
• Any liability that cannot legally be excluded

To the maximum extent permitted by law, Fashion-Brands.store shall not be liable for claims arising from normal wear, aging, patina development, material deterioration consistent with age, or other characteristics commonly associated with authentic pre-owned luxury goods.

16. INDEMNIFICATION

You agree to indemnify and hold harmless Moby-SIM d.o.o. from claims arising from your misuse of the Site or breach of these Terms.

17. FORCE MAJEURE

We are not liable for failure or delay in performance caused by events beyond our reasonable control, including but not limited to natural disasters, strikes, war, pandemics, governmental actions, or supply chain disruptions.

18. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of Bosnia and Herzegovina.

Disputes shall be subject to the jurisdiction of the competent courts of Bosnia and Herzegovina.

If you are an EU consumer, you may also rely on mandatory consumer protection laws of your country of residence.

Nothing in these Terms limits your statutory consumer rights.

19. AUTHENTICITY OF PRELOVED PRODUCTS

All Preloved Products offered on Fashion-Brands.store are represented as authentic and are sourced through trusted suppliers, professional resellers, authenticated luxury networks, collectors, consignors, or other reputable sources.

Each item is authenticated either by Fashion-Brands.store, its suppliers, or trusted third-party authentication partners prior to being offered for sale.

Product condition grades, where provided, represent Fashion-Brands.store's reasonable assessment of the item's condition at the time of listing and are intended solely as a guide.

All measurements, dimensions, capacities, and sizes provided on the Site are approximate and may vary slightly due to manual measurement methods, manufacturing tolerances, or the characteristics of the item. Minor variations shall not be considered defects or grounds for cancellation, return, or refund.

Due to lighting conditions, screen settings, image resolution, and photography techniques, actual colors and appearance may vary slightly from those displayed on the Site.

Product photographs form part of the product description. However, colors, textures, finishes, materials, and visual appearance may vary depending on monitor settings, mobile devices, screen calibration, lighting conditions, and image resolution.
